比較憲法專題研究授課大綱

開課學期：Spring, 2012

本學期之課程，擬以The Bill of Rights in the Modern State (Geoffrey R. Stone et al. eds., 1992)為軸，帶領修課學生研讀有關美國憲法「憲法權利」（constitutional rights）的重要爭議，拓展視野，同時訓練廣角視野與辯論的思考方式。

The Bill of Rights in the Modern State一書，為美國芝加哥大學法學院，為紀念美國憲法Bill of Rights兩百週年，所舉行之”The Bill of Rights in the Welfare State: A Bicentennial Symposium”研討會之論文紀錄。在此論文集之中，有五大主題，分別邀請兩位「立場相反」的大師級學者發表論文，進行對話辯論。其包括：

1.   Property and the Politics of Distrust

2.   Religious Participation in Public Programs

3.   Speech in the Welfare State

4.   Levels of Generality in Constitutional Interpretation

5.   The Concept of Unenumerated Rights

另包括其他會議論文，共十七篇論文。不僅涵蓋美國憲法「憲法權利」之重要爭議，更體現「針鋒相對」之對話模式，以及超越註釋學之多角度思考。

 

上課方式有以下重點：

I.     每位學生認領至少一篇論文作口頭報告。

II.    每組「爭議」主題，負責報告者應進行辯論對話。

III.  每組「爭議主題」，所有修課同學應就同樣主題，就台灣的憲法議題進行辯論。

 

期末繳交符合學術格式之學期報告一篇，評分計算以期末報告為主，期中口頭報告與辯論參與為輔。
