該命令須符合立法意旨且未逾越母法授權之範圍，始為憲法所許。

 

1. 該命令須符合立法意旨 

such rules and ordinances must be consistent  (符合) with the legislative intention (意旨)

A is consistent with B - A 與B 相符

2. 未逾越母法授權之範圍

must not go beyond (逾越) the scope of power granted (授權) by the enabling statute (母法)

3. 始為憲法所許

to be permissible (允許) under the Constitution. (憲法)

 

4. 聲請人對於 XXX 法律申請是否違反憲法解釋

Petitioner demands interpretation (申請解釋) with respect to the question of  XXXX is in conflict with the Constitution. (是否違反憲法) 

5. 符合審理案件法第五條第一項第二款規定之要件，爰予受理，合先敘明。
